BACKGROUND INFORMATION
Sofimed d.o.o. guarantees to any its user his/her right for refund, in case if such user is not satisfied with the quality of the provided services.
Each refund is made by Sofimed d.o.o. with reasonable care and due diligence.
The user, who has paid for the Sofimed d.o.o. services, may request a refund in accordance with the criteria as further set out herein.
Refund will be only considered where the user complies with the eligibility criteria in full. If the user does non complies with any of the eligibility criteria, Sofimed d.o.o. shall save the right, in its sole discretion, to decline the user’s request for a refund.
NOTE:
· Sofimed d.o.o. undertakes to make its best efforts to support the users in case of any disputes related to refunds of purchased services.
· This Refund Policy concerns exclusively payments by Sofimed d.o.o. services and users’ funds.
· This Refund Policy does not cover any additional fees or charges.
GENERAL POINTS
According to the Consumer Rights Directive of 2011 for the European Union, citizens have the right to obtain a refund during 14 days from the date of purchase.
In order to apply for a refund, the user has to send a request to Customer Service email address support@apprendrelangue.com.
To prevent prohibited conduct, all payments and information related to refund may be verified by Sofimed d.o.o.. In such a case, Sofimed d.o.o. may request the user to provide certain information, including, but not limited to email, phone number, first and last name, address or/and any other prove of the fact that disputed payment was made and the reason of refund request. In case if the user fails to provide appropriate information upon the Sofimed d.o.o. request or in case of any doubts as to authenticity of provided information, Sofimed d.o.o. shall be entitled to decline the user’s refund request.
Sofimed d.o.o. shall process the user’s refund request as soon as is reasonably practicable. Response time will vary depending on stated reasons of the refund request. In any case, Sofimed d.o.o. shall notify the user about the outcome of the request in accordance with the timescales set out in this policy.
Refund request will only be approved or declined after meticulous verification of user’s information made by Sofimed d.o.o..
In case a user does not use the provided services, the future payments should be canceled at Unsubscribe link (mentioned in the footer of the site). Sofimed d.o.o. reserves the right make a refund only of the initial payment. All subsequent payments should be conducted with considering of accepting the automatic service renewal by user.
Sofimed d.o.o. reserve the right to provide a partial refund if service was provided. Amount of the refund is determined by personal according to the reason of the refund request and with reasonable care and due diligence.
NOTE:
· Submission of refund request does not guarantee that the user’s request will be satisfied.
· Sofimed d.o.o. reserves the right to contact the user with the request to provide additional information and/or keep updating a user about the status of the refund request.
RETURN ELIGIBILITY CRITERIA
All requests for refund should be provided to Sofimed d.o.o. by email support@apprendrelangue.com.
Refund requests to the Sofimed d.o.o. by email should be sent by email with 'Refund Request' in the subject line.
Sofimed d.o.o. can issue a refund only to the source of the payment.
Only authorized billing agents of Sofimed d.o.o. can issue refunds.
PROCESSING TIMELINE
Within fifteen (5) days as of the date of refund request receipt, Sofimed d.o.o. shall contact the user to request further information (if required) and the user shall provide such information as soon as reasonably practicable but in any case no later than fourteen (14) days following such request.
Sofimed d.o.o. reserve the right notify the user by email on its final decision regarding Refund:
· within five (5) days following the receipt of the last requested additional information;
· within five (5) days following the receipt of refund request if no further information is requested.
NOTE:
· In specific cases, refund may be made without customer's approval.
· Refund will be processed without undue delay, and in any event within ten (10) days beginning with the day on which Sofimed d.o.o. agrees that the user is entitled to a refund.
· The user will have no Refund:
· When the user fails to provide Sofimed d.o.o. with the required information within the terms set in this policy.
· If Sofimed d.o.o. suspects that the user has, or is, engaged in, or have in any way been involved in, fraudulent or illegal activity, including prohibited conduct. There is no ground for refund.
CHARGEBACKS
Sofimed d.o.o. expects the user to contact it using Sofimed d.o.o. contact details to resolve any problem or issue related to his/her payments before the user makes any Chargeback request. This Section does not affect any rights and/or claims, which the user may have against the bank/financial institution.
Sofimed d.o.o. will investigate any chargeback requests made by the user and may request the additional details for a dispute/chargeback initiated from the user's issuing bank.
DISPUTES
With respect to any dispute, claim, or controversy regarding the Site, all rights and obligations and all actions contemplated by these Terms and Conditions shall be governed by the laws of Slovenia as if the Terms and Conditions were a contract wholly entered into and wholly performed within Slovenia. ANY DISPUTE RELATING IN ANY WAY TO YOUR VISIT TO THE SITE, THESE SITE TERMS, AND CONDITIONS, OR THE RELATIONSHIP BETWEEN THE PARTIES (OTHER THAN CLAIMS RELATED TO THE INTELLECTUAL PROPERTY RIGHTS OF Sofimed d.o.o. OR OUR AFFILIATES, PARTNERS OR LICENSORS OR CLAIMS IN EQUITY) SHALL BE SUBMITTED TO CONFIDENTIAL ARBITRATION IN Slovenia AND YOU AGREE TO SUBMIT YOURSELF TO THE JURISDICTION AND PROCEEDINGS THEREOF. ARBITRATION MEANS THAT AN ARBITRATOR(S) WILL DECIDE THE CLAIM, AND YOU WILL NOT HAVE THE RIGHT TO SUE IN COURT OR TO HAVE A JUDGE OR JURY DECIDE YOUR CLAIM. YOUR RIGHTS TO PREHEARING EXCHANGE OF INFOMRATION AND APPEALS MAY ALSO BE LIMITED IN ARBITRATION. It is further agreed that any dispute over the scope of this arbitration provision and any dispute as to whether a claim is arbitral shall be submitted to the arbitrator for decision.
Notwithstanding the foregoing, to the extent you have in any manner violated or threatened to violate our intellectual property rights or the intellectual property rights of our affiliates, partners or licensors or otherwise have a cause of action in equity, we may seek injunctive or other appropriate relief in any court of competent jurisdiction and you consent to jurisdiction and venue in any such court for such purposes. Arbitration under this agreement shall be conducted under the Rules of Arbitration of the International Chamber of Commerce (ICC) by one or more arbitrators appointed in accordance with the said rules. The arbitrator's award shall be binding and may be entered as a judgment in any court of competent jurisdiction. You agree that any arbitration or proceeding shall be limited to the dispute between us and you individually, and:

MISCELLANEOUS
Any charges, which arise upon processing a refund, shall be covered solely by the user. Such charges will be deducted from the final amount of Refund.
This Refund Policy will be amended from time to time if there is any change in the legislation. Terms and conditions of the Refund Policy are subject to change by Sofimed d.o.o. and in the case of any amendments, Sofimed d.o.o. will make an appropriate announcement.
If the user does not wish to accept the revised Refund Policy, he/she should not continue useing Sofimed d.o.o. Services. If the user continues useing the services after the date on which the change comes into effect, his/her usage of services is covered by the new Refund Policy
